Restraint Definition "Physical intervention" means a behavior management technique which uses the least amount of physical contact on the part of a staff member to prevent potential harm to a child or others, to prevent destruction of property, to protect public safety, or in accordance with RSA 627:6.

Seclusion Definition "Seclusion" means the removal of a child to a single room, designed specifically for isolation purposes.
Seclusion Exclusions None.
Criteria for Restraint and Seclusion The following specific punishments shall be prohibited:
  • Isolation or sensory deprivation

  • The use of mechanical restraints.

  • Physical intervention techniques shall be used only to protect the child from risk of harm to himself, herself, others, to property, or to protect the public.

  • Medication used to control a child's behavior shall be authorized only by a written prescription.

  • Seclusion shall be used as treatment intervention and not as punishment.

In-person Assessment Seclusion:
Seclusion exceeding 30 minutes shall be visually monitored no less frequently than every 10 minutes to meet the child's needs.

Seclusion shall be evaluated at a maximum of 60 consecutive minute intervals by the staff member in charge to determine if further use of this intervention is necessary.
Debriefing Seclusion as a treatment intervention shall be reviewed by the executive director, treatment coordinator, or his or her designee.

Training The staff training requirements shall include:
  1. That direct care staff receive 40 hours of training during each year of employment;

  2. Up to 15 hours of documented supervision may be applied toward the training requirement in part 1;

  3. That direct care staff receive training in:
    • Emergency and safety procedures;
    • Principles and practices of child care;
    • Family-centered practices;
    • Child protection reporting law RSA 169-C;
    • Administrative procedures and program goals;
    • Behavior management;
    • Crisis management; and
    • Physical intervention techniques.
Documentation Restraint:
The rationale and authorization for the use of medications to control a child's behavior shall be kept on file in the child's record.

Seclusion:
Seclusion shall include …Documentation of the length of time used and each visual check on the child.
Reporting The facility shall document and share weekly with DCYF each child's behavioral information which includes:

  • A behavioral assessment, signed by the executive director or designee;
  • An indication of the child's motivation/cooperation;
  • Support systems;
  • Mental/emotional functioning;
  • Restrictions or disciplinary actions;
  • Contacts outside the facility; and
  • Medical emergencies or accidents.
Quality Improvement A treatment plan meeting shall be held a minimum of once every 4 months for the purpose of evaluating progress made towards the established goals and objectives.
