Coping with Child Welfare Litigation
Litigation is a current reality in many child welfare agencies. In almost half of
the 50 states, child welfare agencies are operating under the supervision of a
court that has assumed oversight in response to litigation claims that the
public agency has failed to protect abused and neglected children. Every day,
public and private agencies face the risk of becoming deeply enmeshed in the
process of ongoing litigation and court supervision.
NCFC consultants work directly with administrators, supervisors, and workers
to evaluate an agency's strengths as well as its vulnerability to litigation.
They review program plans, policies, and procedures, audits, management
reports, and fiscal information to assess the agency's performance in the
context of national standards. Where necessary, NCFC works with the agency
to correct identified problems and to strengthen case practice, program
outcomes, and staff capability and knowledge. NCFC consulting staff also
work directly with the agency's administrators and attorneys in responding to
litigation and in serving as expert witnesses.
