HHS Issues Program Instruction on New Child Protection Law

On January 8, 1998, the Administration on Children and Families (ACF), Department of Health and Human Sevices (HHS), issued initial program instruction to inform States of the passage of the new Adoption and Safe Families Act of 1997 (P.L. 105-89) and the effective dates for implementation; and to provide guidance for implementing the new law, including the potential impact on a state's State Automated Child Welfare Information Systems (SACWIS) and other information systems.
The law generally became effective November 19, 1997 with limited delays permitted when HHS determines that a State must enact legislation to comply with certain requirements. States must submit certification to their regional ACF office by February 13, 1998 to indicate whether state legislation is required in order to implement the new law. HHS plans to consult with State representatives and experts in the field prior to proposing regulations to carry out the specific provisions of the new law. CWLA will providing input at appropriate points and urges you to take an active role in the process in your state, as implementation efforts proceed over the next several months.
